1. Scope
These Terms of Service (hereinafter "Terms") apply to the use of the kidsbert platform (hereinafter "Platform"), operated by kidsbert GmbH, Hegestieg 20, 20249 Hamburg, Germany (hereinafter "Operator" or "we").
The Platform enables providers to publish children's and family activities, and parents or guardians to find these offers.
2. Contracting Parties and Contract Formation
2.1 Registration
By registering on the Platform, a user agreement is established between the user and the Operator. Registration is free for parents and searchers.
2.2 User Types
The Platform distinguishes between the following user types:
- Searchers (Parents/Guardians): Individuals who search for and find offers
- Providers: Commercial or private providers of children's and family activities who book paid placements
2.3 Requirements
- Registration is only permitted for adults with full legal capacity
- When registering as a provider, all required business permits must be in place
- All information provided during registration must be truthful and complete
3. Platform Services
3.1 For Searchers (free)
- Search and display of children's and family activities
- Filtering by age, location, activity type, and other criteria
- Saving favorites
3.2 For Providers (paid)
- Creation and management of offer profiles
- Publication of offers with descriptions, images, and contact details
- Management of events and dates
- Various placement options depending on offer size
3.3 No Booking Function
The Platform is exclusively a search platform. Bookings, registrations, or contracts for participation in activities are made exclusively between searchers and providers outside the Platform. The Operator is not a party to these contracts and does not facilitate bookings.
4. Prices and Payment Terms for Providers
4.1 Paid Placements
Providers can book paid placements for their offers. Prices depend on the size and type of offer and are available on the Platform.
4.2 Payment Processing
Payment processing is handled by our payment service provider Stripe. Stripe's terms of service also apply.
4.3 Subscriptions
Placements are billed as monthly subscriptions. The term begins on the day of booking.
5. Subscription Cancellation
5.1 Notice Period
Subscriptions can be cancelled monthly at the end of the respective billing period.
5.2 Cancellation Method
Cancellation can be made at any time via the customer portal on the Platform or by email to hello@kidsbert.de.
5.3 Consequences of Cancellation
After cancellation, the offer remains visible until the end of the paid period. It is then deactivated but not deleted. Reactivation is possible at any time through a new booking.
6. User Obligations
6.1 General Obligations
- Truthful and complete information during registration and use
- Confidentiality of login credentials
- Immediate notification of unauthorized account use
- Compliance with applicable laws and these Terms
6.2 Prohibited Actions
Users agree to refrain from the following actions:
- Publication of illegal, offensive, discriminatory, or content harmful to minors
- Infringement of copyrights, trademarks, or other third-party rights
- Distribution of viruses, malware, or other harmful programs
- Automated queries (scraping, crawling) without consent
- Sharing or selling login credentials
- Manipulation of the Platform or its functions
6.3 Special Obligations for Providers
Providers additionally agree to:
- Only post legitimate and actually available offers
- Maintain all required permits and insurance
- Keep offers up to date and remove offers that are no longer available
- Comply with all legal requirements for childcare and activities
7. Content and Rights
7.1 User Content
Users grant the Operator a non-exclusive, worldwide, free right to use, store, and make publicly available the content (texts, images, etc.) they post on the Platform.
7.2 Responsibility for Content
Users are responsible for their posted content. The Operator does not review content in advance but reserves the right to remove content that is illegal or violates these Terms.
7.3 Operator's Rights
All rights to the Platform, its software, design, and content (unless created by users) belong to the Operator.
8. Liability
8.1 Operator's Liability
The Operator is fully liable for intent and gross negligence as well as for damages arising from injury to life, body, or health.
For slight negligence, the Operator is only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the typical, foreseeable damage.
8.2 Disclaimer for Content and Offers
The Operator is not liable for:
- The accuracy, completeness, or timeliness of content posted by providers
- The quality, safety, or legality of activities offered by providers
- Damages arising from participation in activities conducted by providers
Users acknowledge that contracts for activities are concluded directly with providers and the Operator assumes no responsibility for them.
8.3 Liability for User Content
The Operator is not liable for content posted by users. Upon becoming aware of legal violations, corresponding content will be removed immediately.
9. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy.
10. Term and Termination of User Agreement
10.1 Term
The user agreement is concluded for an indefinite period.
10.2 Ordinary Termination
Both parties can terminate the user agreement at any time without notice. Termination is effected by deleting the user account or written notice to hello@kidsbert.de.
10.3 Extraordinary Termination
The Operator may terminate the contract for good cause without notice, particularly in case of:
- Violation of these Terms
- Suspicion of criminal acts
- Payment default (for paid services)
- Damage to the Platform's reputation
10.4 Consequences of Termination
After termination of the contract, the user account will be deleted. Statutory retention obligations remain unaffected.
11. Changes to Terms
11.1 Right to Change
The Operator reserves the right to change these Terms. Changes will be communicated to users by email at least 4 weeks before they take effect.
11.2 Right to Object
Users may object to changes within 4 weeks. If they do not object, the changes are deemed accepted. In case of objection, the contract ends when the changes take effect.
12. Dispute Resolution
12.1 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
12.2 Consumer Arbitration
We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
13.1 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
13.2 Place of Jurisdiction
The place of jurisdiction is Hamburg, insofar as the user is a merchant, legal entity under public law, or special fund under public law.
13.3 Severability Clause
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
